Terms and Conditions (Applicable Online Only)
- These Terms and Conditions ("T&C") govern the access and use of the website www.kareuae.ae (“Website”) and the placing of any orders for the purchase of goods from Chattels and More (“Kare”). These T&C represent the whole agreement and understanding between KARE and the customer that purchases goods from the Website ("Customer").
- By accessing the Website and/or placing any order, Customer represents and agrees to comply with our T&C. If Customer does not agree to accept the T&C, Customer should not access, register our use the Website.
- KARE may terminate Customer’s account at any time, with or without notice, for conduct that is in breach of this T&C.
- These T&C should be read in conjunction with any details provided on the Website about how the Website operates and the services which are available. Customer should also read KARE’s Privacy Policy.
- KARE reserves the right to revise these T&C at any time as it sees fit without any notice, and by using this Website Customer is expected to review the T&C on a regular basis to ensure Customer understands all terms and conditions governing the use of this Website
- The use of the Website shall not be available to persons under the age of 18. Customer represents that he/she is 18 years old or over 18 years.
- By using the Website Customer further undertakes not to make any speculative, false or fraudulent orders.
- Without prejudice to any other rights and remedies, KARE reserves the right to limit or withdraw access to the Website or to cancel any placed order of any person, if KARE believes that the person is under the age of 18 years or has placed speculative, false or fraudulent orders.
- The Customer agrees that KARE may communicate with the Customer by email or by posting notices on the Website. The Customer agrees that all agreements, notices, disclosures and other communications that KARE provides to the Customer electronically satisfy any legal requirement that such communications be in writing. KARE requires the Customer’s agreement during the registration process to send the Customer promotional emails to let the Customer know about any new changes, features or promotional activities added to the Website. If, at any time, the Customer decides that he/she does not wish to receive promotional emails, the Customer can opt out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.
- When a Customer registers an account on the Website the Customer has been or will be required to provide certain information and register a username and password for use on the Website.
- The Customer is responsible for maintaining the confidentiality of, and restricting access to and use of, his/her account and password, and accept responsibility for all activities that occur under his/her account and password. The Customer agree to immediately notify KARE of any unauthorized use of his/her password or account or any other breach of security. In no event will KARE be liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure of the username and/or password.
- No Customer may use another person's account at any time, without the express permission of the account holder. The Customer agree to reimburse KARE for any improper, unauthorized or illegal use of his/her account by any person obtaining access to the Website, services or otherwise by using the Customer’s designated username and password, whether or not the Customer authorized such access.
- Whilst KARE does whatever it can to minimize disruption, KARE is unable to guarantee the availability or error-free status of the Website.
- Customer is responsible for ensuring that its computer system is compatible with, and meets the specifications necessary to use the Website. KARE does not take any responsibility for any virus or other malware Customer may encounter through my Website. Customer should make sure the use of up-to date anti-virus and anti-spyware programmes when browsing the internet.
- Any login details provided to Customer when registering with the Website are exclusive for Customer only, are non-transferable, and must be treated as strictly confidential at all times. If Customer has any concerns regarding its log-in details, or become aware of any misuse, Customer should contact KARE.
- This Website may contain reports, updates or other information provided by third parties. KARE includes this information on the Website as it may be of interest to Customer, and KARE will use reasonable endeavours to ensure that information on the Website are accurate. However, KARE do not represent or warrant that any information is accurate, complete or up-to-date and, to the fullest extent permitted by law, KARE accepts no liability for any loss or damage caused by any reliance placed on such information by Customer or anyone to whom Customer communicate such information.
- If Customer finds any inaccurate information on the Website, Customer may inform KARE and KARE will endeavour to correct it, where KARE agrees, as soon as reasonably practicable.
- Products offered through this Website are only available for delivery to Customers residing in the United Arab Emirates.
- KARE does not take any orders or is responsible for the access of Customers outside the United Arab Emirates.
- KARE reserves the right to withdraw any product from the Website at any time/or remove or edit any material or content on this Website. KARE shall not be liable to Customer or any other third party for withdrawing any product, removing or editing any material or content of the Website.
- The agreement to purchase (“Agreement”) for the purchase of any products offered on this Website shall be deemed to be in place only upon acceptance of Customer’s order by KARE.
- Customer shall follow the shopping process online to place and submit the order to KARE. KARE shall send Customer an email, acknowledging the receipt of the order (“Acknowledgment”). The Acknowledgment shall not be deemed as acceptance of Customer’s order.
- KARE shall accept the order by sending an email to Customer informing Customer that the ordered products have been dispatched (“Order Acceptance”). KARE shall not be bound to supply any other products which may have been part of Customer’s order for which an Order Acceptance has not been send. All orders are subject to availability.
- KARE shall not be liable to Customer or any other third party for refusing to process or accept any order after sending an Acknowledgment but before Order Acceptance.
- The price of the products shall be updated from time to time on the Website. While KARE endeavors to update accurate prices, errors may occur. If KARE determines that an error has occurred for any product which Customer has ordered, KARE shall inform Customer and give the Customer the option to reconfirm the order at the correct price or cancel the order. If KARE is unable to contact Customer, the order shall be treated as cancelled.
- KARE shall not be under the obligation to sell the products at the incorrect price. All displayed prices are inclusive of value added tax. Delivery charges will be calculated at checkout page.
- All purchased items will be displayed in Customer’s shopping basket. Customer shall follow the payment instructions given after pressing “Place Order”.
- Payment can be made via visa, master card, JCB.
- Customer confirms that Customer is the legitimate owner of the respective credit card. Credit cards are subject to validation checks and authorization by the respective bank. KARE shall not be liable for any delay in delivery due to delayed or refused authorization
- The content on the Website and the trademarks, service marks and logos contained therein ("Trademarks") are owned by or licensed to KARE, and are subject to copyright and other intellectual property rights. The Trademarks may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without KARE’s prior written permission. The Trademarks and the content of the Website are for Customer’s information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Systematic retrieval of data or other content from the Website to create or compile, directly or indirectly, a collection, compilation, database or directory without our written permission is prohibited.
- Provided that Customer is eligible to use the Website, Customer is granted a limited license to access and use the Website to the extend Customer has properly gained access to such part of the Website and solely for Customer’s personal, non-commercial use. KARE reserve all rights not expressly granted to Customer in and to the Website, the content and Trademarks.
- If Customer downloads or prints a copy of the content for personal use, Customer must retain all copyright and other proprietary notices contained therein. Customer agrees not to circumvent, disable or otherwise interfere with the security related features of the Website or features that prevent or restrict use or copying of any content or enforce limitations on use of the Website or the content therein.
- The rights granted to Customer under these T&C shall terminate immediately upon breach of any of this T&C by Customer.
Links to this and other Websites
- KARE may provide hyperlinks from the Website to other internet sites which are operated by other organizations. KARE is not responsible for external websites that link to the Website or which are linked from it. The inclusion of hyperlinks does not imply any endorsement of the material on such sites or any association with their operators.
- KARE reserves the right, at its discretion, to prohibit any link from another internet site to materials or information on the Website. Without prejudice to that right, if Customer wishes to link to the Website, Customer may only do so on the basis that Customer link to, but do not replicate, the home page of the Website, and subject to the following conditions:
- the link is neither misleading nor deceptive and must fairly indicate the Website as the destination of the link;
- Customer does not remove, distort or otherwise alter the size or appearance of our Trademarks;
- Customer does not create a frame or any other browser or border environment around the Website;
- Customer does not in any way imply that KARE endorse any products or services other than KARE products on the Website;
- Customer does not misrepresent its relationship with KARE nor present any other false or misleading information about KARE;
- Customer does not otherwise use any of the Trademarks displayed on the Website without KARE’s express written permission;
- Customer does not link from a website that is not owned by Customer;
- any website from which Customer link to the Website does not contain any content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.
- This Website, its content and any services offered through it are provided on an "as is" and "as available" basis. Although KARE does not offer any warranties or conditions and accepts no liability in relation to the Website or its content; to the fullest extent such liability can be excluded by law.
- KARE accepts no responsibility for any use of this Website under Customer’s login details by a third party where Customer has not maintained the confidentiality of the username or password.
- KARE shall only be liable for any direct losses which are reasonably foreseeable at the time any such liability occurs.
- Subject to the applicable laws of the United Arab Emirates, in no event shall KARE, its affiliates, its directors, shareholders or employees be liable to Customer for any direct, indirect, special, incidental, consequential or punitive damages or loses arising from or in any way related to the use of, the inability to use, or the performance of this Website, its content, functionality on or access through this Website, including but not limited to loss of revenue, anticipated profits, loss of business, data or sales or any other type of damage, tangible or intangible in nature. KARE shall not be liable to Customer for any indirect or consequential loss, loss of profit, revenue, anticipated savings or goodwill howsoever arising from Customer’s use of, or inability to use, the Website or information on the Website. Except as provided in these T&C, all terms implied by law are excluded.
- KARE does not exclude any liability in respect of death or personal injury resulting from KARE’s gross negligence or willful misconduct.
- These T&C, including any legal notices and disclaimers contained on the Website, constitute the entire agreement between KARE and Customer in relation to the use of this Website, and supersede all prior agreements and understandings with respect to the same.
- If any provision of these T&C is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these T&C unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
- KARE reserves the right to assign, transfer, and subcontract rights and/or obligations under these T&C without any notification or consent required. However, Customer shall not be permitted to assign, transfer, or subcontract any of its rights and/or obligations under these T&C.
- These T&C shall be governed by the laws of the Emirate of Dubai and those of the United Arab Emirates.
- Any dispute, difference, controversy or claim arising out or in connection with this T&C, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be subject to the exclusive jurisdiction of Dubai Courts.
- KARE endeavors to fulfill Customer’s orders as listed in the Order Acceptance by the delivery date as outlined in the table in Annex 1, if no estimate of delivery date is specified, KARE endeavors to deliver the products within 3-5 working days of the date of the Order Acceptance. The express delivery option within 48 hours will attract addition charges.
- KARE will inform Customer if estimated delivery date cannot be met. KARE shall not be liable to Customer for such delays which are out of KARE’s direct control.
- KARE delivers products within the territory of United Arab Emirates, except the following areas: Abu Al Abyad Island, Al Aryam Island, Bidda Al Motawah, Dalma Island, Das Island, Jabel Dhana, Jebel Jais, Qasr Al Sarab, Shuwayhat, Island, Sir Bani Yas Island.
- Subject to placement of a minimum order as outlined in Annex 1 the delivery is free of charge.
- Customer may cancel an order within 24 hours after receipt of Order Acceptance. Customer shall receive full refund of the price paid for the products (except for delivery, shipping and other charges). Refunds will be credited to Customer’s original method of payment.
- Subject to KARE sole discretion, if the order is cancelled within 3 days from the date of delivery, then Customer shall be entitled to receive the refund in form of a credit note which can be redeemed within a period of 6 month from issuance date.
- Subject to KARE sole discretion, Customer may exchange the product within 3 days from the date of delivery. Unless otherwise agreed, KARE shall issue a credit note valid for a period of 6 months from issuance date.
- Customer is only entitled to a refund/credit note if the products that are returned are in the same condition as received by Customer and if Customers provides original sales invoice and delivery note (if any).
- For following products, Customer shall not be entitled to cancel the order:
- Furniture
- Special order items
- Clearance items
- KARE provides 1 year warranty on all the products (except accessories) from the date of delivery, whereby warranty is excluded for:
- damages caused directly or indirectly to the products after the delivery, wrong mounting, assembling or usage;
- parts which have to be replaced on a regular basis or which have a short life cycle (e.g. consumables, bulbs, locks, textile, etc);
- faults caused by non- cautious treatment, poor maintenance by Customer or by a third party, abnormal use or a use of the products contrary to the instructions of the manufacturer.
2. Warranty ends if the products have been repaired by a non-affiliated third party, use of non- genuine (spare) parts for the repair or if the products are resold.
Upon acceptance of a warranty claim, KARE we will repair or replace such defective product. If repair or replacement is not possible, KARE will refund of the price paid for the products (except for delivery, shipping and other charges). Refunds will be credited to Customer’s original method of payment.
